1. Agreement and eligibility

Paakuu is a product under Redseed Technology, the operator referred to as 'we', 'us', and 'our' in these terms. These Terms & Conditions govern your use of Paakuu. By creating an account or using the platform, you agree to these terms. Our Privacy Policy explains how we handle personal information. If you do not agree to these terms, do not use the platform. You must have legal capacity to enter this agreement, or use the service with the consent and supervision of a parent or legal guardian where permitted by law.

2. Paakuu is a platform

Paakuu provides a platform for community posts, creator content, marketplace listings, services, and events. Unless a particular offer expressly identifies Paakuu as the provider, the relevant user, seller, service provider, or organiser supplies the content, goods, services, or event. Paakuu is not automatically a seller, event organiser, agent, or party to agreements between users.

Users are responsible for the accuracy, legality, ownership, delivery, and performance of their offers. A listing, moderation decision, or account badge is not a guarantee of a transaction or event. Nothing in these terms excludes Paakuu's own obligations or any rights that cannot lawfully be excluded.

3. Accounts and acceptable conduct

Provide accurate account information, protect your sign-in credentials, and use only accounts you are authorised to access. Do not impersonate others, commit fraud, harass users, share private information without permission, infringe intellectual property, distribute unlawful material, bypass security, or interfere with the platform. Do not evade moderation through replacement accounts or re-upload removed material.

4. Your content and our limited permission

You retain your rights in content you upload. You must own the content or have all permissions needed to upload and share it, including permissions relating to identifiable people, music, artwork, and other protected materials.

You grant Paakuu a non-exclusive permission to host, store, reproduce for technical delivery, format, and display your content solely to operate the platform in accordance with your chosen audience and the Privacy Policy. This permission does not transfer ownership and does not include selling your content, AI training, AI dataset creation, or AI generation. It ends when the content is removed, except for limited lawful retention, backups, or evidence needed to resolve disputes.

5. AI restrictions apply to posts only

Paakuu does not feed user posts, including their images, videos, or attached assets into third-party AI systems, use them to train or fine-tune AI, or participate in AI generation using those materials. Uploading or publicly sharing content does not grant Paakuu, other users, or third parties permission to use it for these purposes.

You must not scrape, collect, download, copy, license, or submit another user's Paakuu posts or their attached assets to an AI tool, training pipeline, dataset, or generation service. You must not facilitate such use of posts.

You must not include AI-generated images, videos, or other assets in Paakuu posts, including generative AI artwork, synthetic likenesses, deepfakes, or assets materially altered using generative AI. Labelling an asset as AI-generated does not make it permitted. Ordinary non-generative cropping, resizing, and colour correction are allowed, subject to all other rules.

The AI prohibition applies only to posts. It does not currently apply to events or content uploaded to event pages. Event content must still comply with privacy, intellectual property, and other platform rules. An event promotion published as a post remains subject to the posts rule. We may amend this rule and its scope over time, publishing changes in these terms and providing notice where required.

6. Marketplace, services, and events

Buyers, sellers, service providers, and organisers must clearly agree on the description, price, fees, delivery, cancellation, and refund conditions before a transaction. Organisers are responsible for event details, permissions, admission conditions, safety, and communicating changes. Participants must follow lawful event and ticket rules.

Any specific payment or refund terms presented for a transaction apply alongside these terms, subject to mandatory consumer rights. These terms do not create a blanket no-refund rule or a guarantee that Paakuu will reimburse a transaction. Do not share private ticket codes or invitation links with unauthorised people.

7. Privacy violations and enforcement

You must respect other people's privacy and comply with the conduct requirements in our Privacy Policy. When a violation is established, Paakuu will take action against the responsible user. AI-generated images, videos, and assets that violate the posts rule will be removed from the affected posts. Event content is not subject to removal solely for being AI-generated under the current rule.

Action may include warnings, removing or restricting content, limiting features, suspending an account, or permanently banning a user. Serious or repeated violations may result in immediate suspension or a ban without a prior warning. We may temporarily restrict access while reviewing a credible complaint and preserve relevant evidence where lawful.

Where warranted, Paakuu may refer unlawful activity to the relevant authorities or pursue available legal remedies. Account action does not automatically cancel a user's outstanding transaction obligations or mandatory refund rights. Users may request a review of a moderation decision and provide evidence of authorship or permission.

8. Availability and responsibility

We aim to keep Paakuu available, but access may be interrupted for maintenance, faults, or circumstances outside our control. We do not guarantee the accuracy of user content, uninterrupted availability, or the conduct of other users. Exercise care when meeting people, making purchases, and sharing information.

To the extent permitted by applicable law, Paakuu is not responsible for losses caused by independent user conduct, third-party services, or matters outside its reasonable control. Nothing excludes liability for fraud or any liability, consumer protection, or remedy that cannot legally be excluded.

9. Ending use and changes to these terms

You may stop using Paakuu at any time. Paakuu may restrict or end access for violations as described above. Provisions needed to address outstanding transactions, lawful retention, disputes, and prior misuse continue to apply after access ends.

We may revise these terms and will update the date shown here. Material changes will be notified where required. Changes apply prospectively and do not grant retroactive AI rights over your content.

10. Applicable law and contact

These terms are governed by Malaysian law, subject to any mandatory protections and rights available to you under applicable law. Disputes may be brought before a court or tribunal with the appropriate jurisdiction. Nothing prevents you from exercising statutory complaint or consumer redress rights.
